Terms and conditions

The owner and administrator of the online store at www.diabetyk24.pl is Diabpol Sp. z o.o. entered into the National Court Register by the District Court for the capital city of Warsaw in Warsaw, XIII Commercial Division under KRS no.: 0000365882, NIP (tax ID no.) 7010259045, REGON (corporate ID no.) 142611096, with a share capital of PLN 141,200, having its registered office in Warsaw at ul. Traktorzystów 28D.

Accepting and completing orders

The store sells goods through the Internet, by phone and by email. The list of goods available in the store is available on: www.diabetic24.com

All prices listed on the website are gross amounts expressed in PLN. The prices are exclusive of shipping costs.

By placing an order with www.diabetic24.com online store customers agree to the terms of sale set forth in the Terms and Conditions, and both parties become obliged to comply therewith.

By placing an order you agree to the obligation of payment.

All products available in the store are new and free from legal and material defects.

In placing an order the customer specifies the product, shipping method, shipping address and address to be placed in a sales document, as well as method of payment for the order.

After an order is placed, the customer will receive an order confirmation by email.

Orders will not be accepted if the data provided in the order form is incomplete. Such orders will be cancelled as soon as the deficiency referred to in the previous sentence is found.

The order will be handed over for fulfilment provided that the ordered items are in stock or available from the supplier. If the ordered items are unavailable, the customer will receive an email with notification about the order status and on such basis the customer shall decide on the course of action, or they may withdraw their order altogether.

Should the customer withdraw their order due to unavailability of any or all of the ordered items, the customer who made an upfront payment or paid by card will be reimbursed for the order within 7 days of the date of order cancellation.

The number of items available at a discount or put on sales is limited, therefore, the orders will be completed on the first come first served basis. The customer will be advised of inability to complete their order due to unavailability of ordered items by email or by phone by an employee of www.diabetic24.com.

Every order placed with the online store is documented by a VAT invoice or a receipt. By accepting the terms and conditions, the customer agrees to the issue of an invoice without a signature.

The customer will receive a confirmation of conclusion of an agreement by email.

Changing orders

The customer may introduce changes in their order up until the moment of completion of the order, i.e. the time of handing over the order for shipping. No changes will be possible thereafter; the only option will be to cancel the entire order and place a new order with correct data.

The above-mentioned changes will be acceptable subject to prior contact with the store at shop@diabetic24.com. The changes will be introduced upon the customer is established as the owner of an account.

Payment methods

When placing an order the customer can choose a preferable shipping and payment method according to the options available in the order form.
We accept the following payment methods:

credit card through the Internet - orders paid for by credit card will be completed subject to authorisation by the online payment service provider and Customer's bank;

online wire transfer - orders paid for with an online wire transfer will be completed subject to authorisation by the online payment service provider and Customer's bank;

transfer to bank account (orders will be completed after the amount is credited to the bank account of the Seller).

The prices given on the online store website are binding at the time of placement of order.

Complaints

All products available in our store are new and come from a legal source.

All products are free from material and legal defects.

If the customer finds any manufacturer defects in a product, they may file a complaint or use a warranty.

Complaints will be handled within 14 days and within this period, if the complaint is not rejected, the product will be replaced or the Customer will receive reimbursement for its costs to their bank account. In the event of admitting the complaint, the Customer will be reimbursed for the costs of the product up to the amount paid by the Customer. In the event of admitting the complaint, the Seller will cover the costs of re-shipping the goods to the Customer.

Withdrawal from agreement and return of goods

According to the Act of 30 May 2014 on consumer rights (Journal of Laws 2014, item 827) the customer shall have the right to return purchased goods within 14 days of receipt thereof.

The time limit for return of goods expires after 14 days of the day on which the customer obtained possession of the items or on which a third party other than the carrier, indicated by the customer, obtained possession of the items.

To observe the time limit the customer has to send a notice of withdrawal in writing before the expiration of the time limit.

As a result of withdrawal, the agreement is deemed not concluded and the parties shall return the objects of performance to one another.

The consumer shall cover the direct costs of shipping the items back to the seller. The amount of costs is contingent on the prices applied by the post operator.

The consumer is obliged to return items to the entrepreneur or hand them over to a person authorised by the entrepreneur as promptly as practicable, however, not later than within 14 days of the day of withdrawal from the agreement, unless the entrepreneur himself agreed to pick up the items. To observe the time limit the items have to be sent back before expiration thereof.

The customer shall have no right to withdraw from the agreement if:

the object of performance is a product that breaks easily or has a short shelf life;

the object of performance is a product delivered in a sealed packaging, which is not suitable for reuse after the packaging is opened due to health protection or hygiene aspects, if the packaging has been opened upon delivery;

The consumer shall be liable for decreased value of items if the same results from improper use thereof which goes beyond the limits required for establishment of the nature, features and functions of the items.

The consumer will be reimbursed within 14 days of receipt of a consumer's statement on withdrawal from agreement, however, if the Store did not make a proposal to pick up the items from the consumer, it may delay the return payment to the consumer until it receives the items back or until the consumer provides a proof of posting, whichever happens first. The return payment shall take the same form as the original payment.

Shipping costs:

Goods shipped by DPD courier service.

Shipping costs amount to EUR 25.

Delivery time

International orders take 4 to 14 business days to deliver, depending on the country of destination.

Important: The store shall not be held liable for failure to deliver any goods or delays in delivery resulting from inaccurate shipping address provided by the customer.

Payments methods:

Orders paid for by PayPal will be completed once the amount is credited to our PayPal account

  • PayU – credit card

Orders paid for by credit card will be completed subject to authorisation by the online payment service provider and Customer's bank

  • Transfer to bank account

Orders will be completed once the amount is credited to the bank account of the Seller

Personal data

The administrator of personal data is Diabpol Sp. z o.o. with its registered office in Warsaw at ul. Traktorzystów 28D. The personal data will be processed for the purpose of placement and realization of orders placed with www.diabetyk24.pl online store and, subject to appropriate consents, for the purpose of sending marketing communications by email, participation in a loyalty programme or for a customer satisfaction survey or for telemarketing calls associated with special offers on www.diabetyk24.pl. Anyone who provides their data shall have the right to access and amend it. The data is provided voluntarily, however, it is essential for the purpose of fulfilment of the above objects.

The personal data is protected according to the Act of 29 August 1997 on personal data protection (Journal of Laws no. 133, item 883) to prevent unauthorised access.

Registration

The customer may register with www.diabetic24.com online store system.

The customer has to be either a natural person of full age (18) with full legal capacity or a legal person or a non-corporate entity with full legal capacity.

For the purpose of Registration the Customer has to complete a registration form and provide the following data:

first name and surname or business name

address;

contact tel. no.

email address,

and choose a name - login, which they will use in the store system, and a password.

Cookies are small text files that are stored on Customer's device used to view the online store website.

What cookies do?

Provide security and make for a smooth operation of the Store.

Final Provisions:

The product information placed on the Store website is not an offer, as defined in the Civil Code. The information constitutes an invitation to negotiations (according to Art. 71 of the Civil Code). We reserve the right to refrain from completion of an order for a valid reason.

All product information comes from materials published and approved by manufacturers. The actual appearance of items may diverge from that presented on the website, e.g. as a result of different monitor settings or monitor quality.

By placing an order with the online store the customer agrees to the terms and conditions and becomes obliged to comply with the provisions thereof.

Any disputes arising out of the Sales Agreement shall be subject to settlement by a competent court according to the applicable provisions of the Code of Civil Procedure.
